OBIETTIVI FORMATIVI

Il corso si svilupperà in una dimensione storica, culturale, giuridica ed applicativa con lo scopo di formare giuristi ed operatori pratici del diritto agrario per raggiungere un livello di eccellenza professionale. L’'obiettivo essenziale del Corso è quello di fornire allo studente una conoscenza dettagliata ed integrale degli istituti del diritto agrario evidenziandone la specificità e al contempo le connessioni con il diritto civile; una conoscenza  che gli consentirà di padroneggiare una serie irrinunciabile di categorie giuridiche e di nozioni tecniche in virtù dell’ acquisizione di informazioni e concetti  finalizzati al ragionamento critico ed alla comprensione dei nuovi problemi giuridici che il diritto agrario dell'era contemporanea produce incessantemente. Il corso  offre in definitiva agli studenti gli strumenti per comprendere l'importanza fondamentale del settore primario e la rilevanza produttiva e agroambientale dell'impresa agricola con riguardo anche alla  tutela della qualità e sicurezza dei prodotti alimentari nello scenario della sostenibilità ambientale.

CONOSCENZA E CAPACITA' DI COMPRENSIONE

- degli istituti del diritto agrario, evidenziandone le specificità e le correlazioni con il diritto civile e con i valori della Costituzione e dell'ordinamento sovranazionale in una dimensione anche storica in relazione al passaggio dal codice civile del 1865 al codice civile del 1942 con l'analisi del progetti e dei contributi dei più importanti giuristi impegnati nella riforma del codice civile.

- della attuale produzione legislativa e giurisprudenziale in materia

Gli studenti dovranno acquisire capacità di valutazione di studi e contributi e orientamenti giurisprudenziali

Gli studenti dovranno acquisire la capacità di organizzare il ragionamento giuridico e di muoversi nel complesso sistema del diritto agrario per raggiungere un livello di eccellenza professionale nella qualificazione dei fatti e nella risoluzione dei problemi pratici

Gli studenti grazie allo studio dei contributi scientifici e dei casi giurisprudenziali saranno in grado di fornire risposte applicative rispetto alle criticità della materia

LEARNING OUTCOMES:

The course will develop in a historical, cultural, legal and applicative dimension to train jurists and professionals of agricultural law with the achievement of a level of professional excellence. The essential objective of the course is to provide the student with a detailed and integral knowledge of the institutions of agricultural law in correlation with the rules and principles of public and private law; a knowledge that will allow him to understand an indispensable series of legal categories and technical notions by virtue of the acquisition of information and concepts aimed at critical reasoning and the evaluation of the new legal problems that contemporaneity produces.

KNOWLEDGE AND UNDERSTANDING:

- of the institutions of agricultural law, highlighting their specificities and correlations with the values ​​of the Constitution and of the supranational order

- of the most important legislative and jurisprudential production on the subject

Students will have to acquire the ability to evaluate studies and contributions and jurisprudential orientations

- APPLYING KNOWLEDGE AND UNDERSTANDING:

Students will have to acquire the ability to organize legal reasoning and to move in the complex system of agricultural law to achieve a level of professional excellence in the qualification of facts and in the resolution of practical problems.

MAKING JUDGEMENTS:

Students with the study of scientific contributions and jurisprudential cases will be able to provide applicative answers with respect to the critical issues of the matter

COMMUNICATION SKILLS:

The course provides for the acquisition of a technical and scientific background to understand agricultural law institutes

the learning ability will be stimulated with the critical discussion of the topics covered with doctrine and jurisprudence

Programma

Il corso prevede 40 ore di lezione che si svolgono in 10 settimane; ogni settimana prevede 4 ore di lezione. Per ciascun tema specifico si prevede una lezione con una scansione temporale tra le 2 e le 4 ore

Il corso sarà organizzato con lezioni frontali secondo le modalità previste dall’Ateneo. Nell'ambito del corso verranno distribuiti agli studenti frequentanti saggi e decisioni giurisprudenziali.

Si prevede la possibilità di una prova intermedia in forma orale  su alcune parti del programma: tema 1,tema 2, tema 3, tema 4  (cfr. contenuti specifici del programma).

L'apprendimento viene verificato con la prova di esame mediante quesiti che vertono sul programma dell'insegnamento e che siano tali da consentire allo studente di dimostrare l'acquisizione di metodo critico, analitico e sistematico a fronte del dato normativo.

Nello specifico si chiede di dare prova della conoscenza delle nozioni fondamentali della materia e di mostrare capacità di argomentare adeguatamente, mettendo a confronto posizioni diverse.

La valutazione finale viene espressa attraverso un voto numerico che sintetizza il livello di approfondimento e di capacità critica raggiunto dallo studente.

POSSIBILE MODALITÀ DI GRADAZIONE DEL VOTO:

18-21: Lo studente ha acquisito i concetti di base della disciplina;

22-25: Lo studente ha acquisito i concetti di base della disciplina e la capacità di collegamento tra i diversi istituti, con un linguaggio appropriato e corretto;

26-29: Lo studente dimostra una conoscenza della materia completa e ben strutturata; dimostra capacità di rielaborare in maniera autonoma le conoscenze acquisite e mostra, altresì, capacità di analisi con linguaggio appropriato e puntuale.

30 - 30 e lode: Lo studente dimostra un insieme di conoscenze completo e approfondito; ottima capacità di analisi dei problemi applicativi, accompagnata dall'utilizzo di un linguaggio giuridico esemplare.

The course will be organized with lectures according to the methods provided by the University. As part of the course, essays and jurisprudential decisions will be distributed to attending students. Attending students  (including ERASMUS students) will be able to replace some parts of the suggested text with notes and teaching material provided with the further possibility of agreeing on the exam program on the basis of the topics covered in class and to make use of the materials distributed by the teacher.

It is foreseen the possibility of an intermediate test in oral form on some parts of the program: theme 1, theme 2, theme 3, theme 4 (see specific contents of the program). The grade obtained in the mid-term test will have an objective impact on the final oral assessment in which it is possible for the attending student to also illustrate a topic that he appreciates and deepens.

 ORIENTATIVE GRADING SCALE:

18-21: The student masters the basic concepts of the discipline;

22-25: The student masters the basic concepts of the discipline and the has ability to connect the different subjecs, with an appropriate and correct language.

26-29: The student demonstrates a complete and well-structured knowledge of the subject; demonstrates the ability to independently rework the knowledge acquired; and also shows analytical skills with appropriate and punctual language.

30 - 30 laude: The student demonstrates a complete and in-depth set of knowledge; excellent ability to analyze application problems, accompanied by the use of an exemplary legal language.

La didattica sarà organizzata con lezioni frontali secondo le modalità previste dall’Ateneo. Nell’ambito del Corso saranno sottoposti agli studenti  alcuni casi giurisprudenziali tra i più recenti ed innovativi allo scopo di promuovere una capacità critica  ed argomentativa degli studenti stessi. Si confronteranno le categorie e le nozioni acquisite - con la guida costante del docente -  con le soluzioni adottate dai giudici. In questa prospettiva, sarà progressivamente stimolata la partecipazione attiva degli studenti.

he course will be organized with lectures according to the methods provided by the University. As part of the course, students attending some of the most recent and innovative jurisprudential cases will be submitted to the students in order to promote a critical and argumentative ability of the students themselves. The categories and notions acquired will be compared - with the constant guidance of the teacher - with the solutions adopted by the judges. In this perspective, the active participation of students will be progressively stimulated.
